The Supreme Court has reversed an order of the Supreme Appellate Court of Gilgit-Baltistan

KARACHI: The Supreme Court has reversed an order of the Supreme Appellate Court of Gilgit-Baltistan and a contempt of court notice issued earlier to Shaheen Air International Deputy Managing Director Faisal Rafique.

The SC said in its April 5 verdict that any order passed by the appellate court should not be implemented in Pakistan as defined in Article 1(2) of the Constitution. It said the jurisdiction of the appellate court, which was set up under the Gilgit-Baltistan Order 2009, was limited to Gilgit-Baltistan only. The SC said that the appellate court was however issuing orders to people outside its jurisdiction in violation of the law. The airline took the stance that the appellate court had been passing orders arbitrarily, not on the basis of any violation of law by the airline. The airline said the appellate court had been issuing orders to it to start flights from the area, even though no law required it to do so.
